1. General

1.1 AI-R’s Commitment to Privacy

AI-R Metaverse Limited (“AI-R”) pledges to comply with the requirements of the Personal Data (Privacy) Ordinance (Cap.486 of the Laws of Hong Kong) (“Ordinance”). We are committed to protecting and keeping in strict confidence any personal data (as defined below) collected.

1.2 Purpose of this Statement

This Privacy Policy Statement (“Statement”) is important and should be read thoroughly in order to understand the privacy policies of AI-R in respect of any personal data it collects from you, as a data subject (as defined below).

1.3 Amendments to the Statement

AI-R may amend, update, vary, or add to this Statement from time to time without any prior notice as necessary, and any revised Statement will be published on this website.

1.4 Agreement to Terms

By accessing and using our websites, mobile applications, cloud services, or digital platforms owned and/or administered by AI-R (collectively referred to as “AI-R Platforms”), you are agreeing to the terms and conditions set out herein.

1.5 Language Consistency

If there is any inconsistency between the English version and the Chinese version of this Statement, the English version shall prevail.

2. Type of Personal Data

2.1 Definition of Personal Data

The term “personal data,” wherever mentioned in this Statement, includes the following kinds of information:

1. All the data which may be collected or held by AI-R from time to time in connection with the registration and establishment of a user’s account or the use or continuation of provision of services, products, and facilities. This includes:

   • Full name

   • Date of birth

   • Correspondence address and/or residential address

   • Email address

   • Telephone number

   • Fax number

   • Hong Kong Identity Card Number or travel document number

   • School name

   • Class code

   • Information as referred to in the paragraphs below under ‘Cookies, Domain Names and IP Addresses’

2. Information collected through computer technologies by third parties whom AI-R works with to find out more about users of AI-R Platforms, including the number of visitors, behavior, and usage patterns, for more accurate reporting and to improve the effectiveness of marketing of AI-R.

3. Other data collected from data subjects in the ordinary course of the continuation of the relationship between AI-R and data subjects such as the following:

   • When a data subject uses AI-R’s website

   • When a data subject registers to conduct online activities through any of AI-R Platforms

   • When a data subject submits any statement or content through AI-R Platforms

   • When a data subject takes part in any activities published by AI-R on its website

   • When a data subject makes a purchase or obtains a product or service introduced or referred to by AI-R on its website

   • When a data subject participates in online activities published on AI-R Platforms, including learning software, online learning games, competitions, assessments, exercises, and other activities

2.2 Categories of Data Subjects

The term “data subject(s)” includes the following categories of individuals:

• Students

• Parents

• Guardians

• Teachers

• Users of AI-R Platforms

• Users of related services and products provided by AI-R or its partners

2.3 Exclusion of Incorporated Bodies

For the avoidance of doubt, “data subjects” shall not include any incorporated bodies. This Statement applies to individuals and forms part of any contracts for services that data subjects have or may enter into with AI-R. If there is any inconsistency between this Statement and the relevant contract, this Statement shall prevail. Nothing in this Statement shall limit the rights of the data subjects under the Ordinance.

3. Cookies, Domain Names, and IP Addresses

3.1 Use of Cookies

When you browse AI-R Platforms, your visit may be recorded for analysis on visitor flow and general usage patterns. Some of this information will be collected through the use of cookies.

3.2 What Are Cookies?

“Cookies” are small bits of information that are automatically stored on your computer’s hard drive. Cookies can make the site more useful by storing information about your preferences on particular websites and enabling AI-R to provide more useful features for its users. The information collected by cookies is anonymous aggregated research data and contains no personal contact information.

3.3 Disabling Cookies

Most web browsers are initially set to accept cookies. If you prefer, you can disable cookies, but this may limit functionality on AI-R Platforms.

3.4 IP Addresses

Every time you log into AI-R Platforms, AI-R automatically collects your domain name and IP address for verification purposes and uses such data for visitor flow statistical and data analysis.

4. Collection of Personal Data

4.1 When Data is Collected

From time to time, it is necessary for data subjects to supply AI-R with personal data in connection with the registration, establishment of accounts, or the provision of services or facilities.

4.2 Data from Third Parties

AI-R may work with third parties that use applications or computer technologies to collect additional information about users for service improvement.

4.3 Failure to Provide Data

Failure to supply such personal data may result in AI-R being unable to register or provide services, products, and facilities.

5. Protection of Children Under the Age of 18

5.1 Parental Consent

Data subjects under the age of 18 must obtain permission from their parents or legal guardians before providing any personal data to AI-R.

6. Purposes of Use of Personal Data Collected

6.1 Purposes for Using Personal Data

The purposes for which the personal data relating to the data subjects may be used will vary depending on the nature of the data subjects’ relationship with AI-R Metaverse Limited. They may include the following:

1. Assessing the merits and suitability of the data subjects as actual or potential applicants for services, products, and facilities;

2. Conducting statistical and data analysis;

3. Allowing a purchase or obtaining of a product or service introduced or referred to by AI-R;

4. Communicating with data subjects or their authorized representatives;

5. Enabling AI-R to ensure smooth operation of the products, services, and facilities provided to the data subjects, as well as improving, optimizing, and configuring these services for the data subjects;

6. Researching, designing, or implementing related services, products, and facilities;

7. Marketing services, products, and other purposes (please see further details under "Direct Marketing" below);

8. Conducting, or allowing to be conducted, research on usage and activities on parts of AI-R Platforms, including the number of visitors, behavior, and usage patterns, for more accurate reporting and to improve the effectiveness of marketing by AI-R;

9. Performing investigations or inquiries into any illegal conduct;

10. Complying with obligations, requirements, arrangements, or procedures that apply to AI-R or that AI-R is expected to comply with, according to:

    1. Any law binding or applying to it within the Hong Kong Special Administrative Region (“Hong Kong”), existing currently and in the future;

    2. Any guidelines or guidance given or issued by legal, regulatory, governmental, tax, law enforcement, or other authorities, or self-regulatory or industry bodies within Hong Kong, existing currently and in the future; and

    3. Any contractual obligations or other commitments applying to AI-R under any contractual arrangement AI-R has with its agents, representatives, contractors, business partners, or other third parties with which AI-R has entered into a contractual relationship;

11. Maintaining a usage or purchase history or pattern of data subjects for AI-R to evaluate future opportunities in products, services, and facilities;

12. Purposes incidental, associated with, or relating to any of the above items (i) to (xi).

7. Transfer of Personal Data Collected

7.1 Disclosure of Personal Data

Personal data held by AI-R relating to data subjects will be kept confidential, but AI-R may provide and disclose such personal data to the following parties for the purposes set out in the previous section:

1. Any agent, contractor, business partner, or other third party which AI-R works with in its provision of such service, product, or facility, wherever situated;

2. Any party that a data subject has initiated a business transaction with or will make a payment to or through;

3. Any party to whom AI-R is under an obligation or otherwise required to make disclosure under the requirements of any law binding or applying to it within or outside Hong Kong, or any disclosure under and for the purposes of any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement, or other authorities, or self-regulatory or industry bodies with which AI-R is expected to comply, or any disclosure pursuant to any contractual or other commitment of AI-R, all of which are within Hong Kong and may exist currently and in the future;

4. Any party authorized to receive a response from AI-R in accordance with Part V of the Ordinance.

8. Storage of Personal Data and Security

8.1 Secure Storage

All personal data collected from data subjects will be stored in secure servers of AI-R to prevent unauthorized or accidental access, processing, or erasure.

8.2 Commitment to Data Security

AI-R maintains its commitment to data security by implementing appropriate physical, electronic, and managerial measures to safeguard and secure personal data.

8.3 Retention

AI-R will take all practical steps to ensure that personal data will not be kept longer than necessary and will comply with all statutory and regulatory requirements of Hong Kong concerning the retention of personal data.

8.4 User Precautions

While AI-R does everything it can to protect personal data from unauthorized use, processing, and disclosure, data subjects should take precautions not to share, provide, or facilitate unauthorized use of their unique username and password assigned by AI-R. If unauthorized transactions are discovered, data subjects should inform AI-R immediately.

9. Direct Marketing

9.1 Consent for Direct Marketing

AI-R intends to use the data subject’s data in direct marketing and requires the data subject’s consent (which includes an indication of no objection) for that purpose.

9.2 Marketing Content

The name, contact details, product and services portfolio information, usage pattern, and demographic data of the data subject held by AI-R may be used to market:

1. Services, products, and facilities related to AI-R;

2. Co-branding partners of AI-R for a particular service, product, or facility as listed on AI-R’s website.

9.3 Opt-Out

If a data subject does not wish to receive marketing and promotional materials from AI-R, they may opt out at any time by clicking the unsubscribe link in promotional emails or contacting AI-R via email, fax, or mail. AI-R will act on the request within 10 working days at no cost to the data subject.

10. Rights of Access or Correction of Personal Data

10.1 Access Requests

In accordance with the terms of the Ordinance, AI-R has the right to charge a reasonable fee for processing any data access request. Data access requests must be made in writing using the prescribed form under the Ordinance.
